Judge Mpostoli Twala at the Gauteng High Court must decide whether the court has jurisdiction to consider arguments for and against the constitutionality of the NHI Bill, reported News24 (6 March 2025)
This follows a submission to the High Court by the Board by Healthcare Funders (BHF) and the SA Private Practitioners Forum (SAPPF), questioning whether President Cyril Ramaphosa adequately considered the concerns raised about the NHI Act’s constitutionality.
The President’s legal team maintains that the matter belongs with the Constitutional Court, not the High Court.
Advocate Max du Plessis SC, acting for the SAPPF, argued that Ramaphosa needed to send the Bill back to the National Assembly due to the constitutional concerns raised.
Judge Twala reserved judgment on the matter after two days of legal arguments.
