High Court rules in favour of SAPPF and BHF in its case against NHI Act

On 6 May the Gauteng High Court ruled in favour of the BHF and SAPPF in its case against Pres Cyril Ramaphosa and Minister of Health. On 4 May SAPPF and the BHF requested the Court to review and set aside Pres Ramaphosa’s decision to sign the NHI Act into law.

The court ordered:

  1. the Gauteng High Court has jurisdiction to entertain the matter;
  2. the President's decision to assent and sign the National Health Insurance Act is reviewable;
  3. the first respondent is ordered to furnish the record of the impugned decision within ten (10) calendar days of this court order; and
  4. the first and second respondents are ordered to pay costs.

The Government has 10 days to respond to the order
